Midwife Soheila Moghaddam was sentenced on Thursday to a minimum 10-month custodial sentence but, because of special circumstances, she will serve the time under intense supervision from her home.

Moghaddam, 46, stood shaking as magistrate Katherine Thompson sentenced her in the Downing Centre District Court to a maximum jail term of 18 months for negligent driving occasioning death.

But instead of spending time behind bars, she will serve an intensive correction order whereby she will be monitored and have to perform community service.

Moghaddam lost control of her Nissan four-wheel-drive while performing a three-point turn in a school driveway and struck Akshaaye Revin, 6, and his two cousins on December 18. Akshaaye was killed.

One of the victims, a four-year-old girl, is expected to have a limp for the next 10 years. The car's front wheel went over her, leaving her pinned under the back of the car with a crushed pelvis.

Moghaddam walked out of the court complex with her lawyer and did not make any comment as she hid behind a black umbrella.

A court has previously heard she had moved her children to a different school and was now too scared to drive.

The lawyer said previously said that Moghaddam, whose two school-aged daughters were in the car when the accident happened, was badly shaken by the ordeal.

"It [the court] couldn't hand down a harsher punishment than she gives herself every day," he said.

"She's extremely grieved. We ask for you all to respect her privacy."

Akshaaye's uncle had previously told Fairfax that he did not want to see anyone punished.

"It was an accident," he told Fairfax in February.

"But we could all take more time to do things. I don't know what you can do to make it safer but I'd like to see more police presence around the front of schools just on the odd occasion to speak to people who they see doing silly things."

He said their family hoped Moghaddam could move on in the future.

"That's our main feeling. There's no point in ruining other people's lives."

The school has previously banned the practice of turning into the school's driveway during the morning and afternoon drop-offs.
